Service Policy for MindAlgo Innovations Private Limited
By accessing the MindAlgo platform, including the mobile application, web interface, and all automated wellness tools (‘Platform’), you (‘User’) agree to be legally bound by these Terms and Conditions (‘Terms’). These Terms constitute a binding agreement between you and MindAlgo Innovations Private Limited (‘MindAlgo’, ‘we’, ‘us’, or ‘our’).
If you do not agree to these Terms, you must immediately discontinue use of the Platform. Continued use of the Platform following any update to these Terms constitutes acceptance of the revised version.
The Platform is intended solely for individuals who are 18 (eighteen) years of age or older. By using this Platform, you represent and warrant that you are at least 18 years of age.
Users under the age of 18 are strictly prohibited from registering on or using the Platform. If we become aware that a minor has registered, their account will be immediately terminated and all associated data deleted in accordance with our data protection obligations.
By accepting these Terms, you represent that you have the legal capacity to enter into a binding contract under applicable Indian law.
MindAlgo provides a digital Cognitive Operating System through four distinct service tiers:
The scope and features of each tier are subject to change. MindAlgo will notify users of material changes through the Platform or via registered email.
MindAlgo is a digital wellness platform and is NOT a medical device, clinical tool, or mental health service. The wellness scores, stress indicators, and cardiac coherence metrics generated by the Platform are provided for educational and self-improvement purposes only. They are not intended to diagnose, treat, cure, or prevent any clinical psychiatric, neurological, or medical disorder.
Users with existing medical conditions, mental health diagnoses, or those taking prescription medications are strongly advised to consult a qualified licensed medical professional before using the Platform.
MindAlgo utilizes two complementary scanning technologies to estimate physiological indicators: (a) Wellness Scan, which uses your device's front-facing camera to optically detect cardiovascular signals without physical contact; and (b) Finger Scan, which uses a touch-based sensor in direct contact with the skin to capture optical pulse signals. Together, these technologies estimate physiological indicators including Heart Rate (HR), Heart Rate Variability (HRV), and blood oxygen saturation (SpO2). You expressly acknowledge and agree that:
The MindAlgo Brain is an AI-powered automated wellness companion. Its responses are generated by algorithms and do not constitute professional psychological, psychiatric, or medical advice. The AI does not replace a licensed therapist, counsellor, or physician. Users must not rely on MindAlgo Brain outputs for clinical decision-making.
MindAlgo does not provide crisis intervention, emergency response, or emergency medical services. If you are in immediate danger, experiencing a medical emergency, or having suicidal thoughts, contact the appropriate emergency services immediately:
To protect the integrity of the MindAlgo platform and the safety of our community, the following conduct is strictly prohibited and will result in immediate and permanent account termination without refund:
Users shall not attempt to spoof, manipulate, or falsify physiological data (vitals scans) using external hardware, software, or any other means to deceive the AI-driven wellness system.
Any generation or sharing of sexually explicit, abusive, lewd, threatening, or otherwise offensive content within the MindAlgo Brain chat interface or community forums is strictly prohibited.
Chargeback fraud, use of stolen or unauthorised financial accounts, or any attempt to obtain services without legitimate payment will be reported to the relevant financial institutions and law enforcement authorities.
Creating false profiles, impersonating another person, or misrepresenting qualifications (e.g., falsely claiming to be a medical professional to extract clinical advice) is prohibited.
The Shift and Reset programme tiers involve delivery of proprietary neuro-analytics, data-mapping, and personalised content upon initiation. Due to the immediate and irreversible nature of this digital delivery, these programmes are non-refundable once access has been initiated, unless the service is found to be materially defective.
In the event of account termination arising from a violation of Section 5 (Ethical Use & Anti-Fraud Policy), all paid fees are forfeited and non-refundable.
Nothing in this section shall override the statutory rights of consumers under the Consumer Protection Act, 2019, including the right to seek redressal for unfair trade practices or deficiency in service.
Initiating an unjustified chargeback while continuing to access the service constitutes fraud and may result in legal action.
All content on the Platform, including but not limited to the MindAlgo Series, the MindAlgo Brain logic and interface, Neuroscience Protocols, wellness algorithms, assessment frameworks, training materials, and visual assets, is the exclusive intellectual property of MindAlgo Innovations Private Limited and is protected under the Copyright Act, 1957 and applicable Indian and international intellectual property laws.

Any violation of this section may result in civil and/or criminal liability under applicable law.
You agree to indemnify, defend, and hold harmless MindAlgo Innovations Private Limited, its directors, officers, employees, affiliates, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
MindAlgo Innovations Private Limited shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of, or inability to use, the Platform, even if advised of the possibility of such damages.
Our total aggregate liability to any user shall be strictly limited to the total amount actually paid by that user for the specific service tier.
MindAlgo shall not be liable for any outcomes, decisions, or actions taken by a user based on wellness data, AI companion responses, or assessments provided by the Platform.
MindAlgo Innovations Private Limited shall not be liable for any failure or delay in the performance of its obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, cyberattacks on third-party infrastructure, government-mandated restrictions, telecommunication outages, or failures of third-party service providers.
In the event of a force majeure event, we will notify users as promptly as practicable and endeavour to resume normal services at the earliest opportunity.
MindAlgo Innovations Private Limited acts as the Data Fiduciary under the Digital Personal Data Protection Act, 2023 (DPDPA) for all personal and sensitive data collected through the Platform.
We collect the following categories of data: (a) Identity and contact information provided during registration; (b) Biometric and physiological data processed in real-time via Wellness Scan (camera-based) and Finger Scan (contact sensor-based) technologies (Heart Rate, HRV, SpO2); (c) Usage and behavioural data; (d) Device and technical data.
By using the Platform, you provide free, specific, informed, and unambiguous consent to the processing of your personal data as described in our Privacy Policy, which forms an integral part of these Terms. You may withdraw consent at any time by deleting your account, subject to any legal obligations requiring data retention.
As a Data Principal, you have the following rights:
MindAlgo employs industry-standard encryption and security measures aligned with SOC 2 practices. Biometric data captured via Wellness Scan and Finger Scan sensors is processed in real-time and encrypted at rest and in transit. We do not sell or share your private wellness data with third parties without your explicit consent, except as required by law.
We retain your personal data only for as long as is necessary to fulfil the purposes described in our Privacy Policy or as required by applicable law. Upon account deletion, your personal data will be erased within 30 (thirty) days, subject to legal retention requirements.
In accordance with the Information Technology Act, 2000, the Consumer Protection (E-Commerce) Rules, 2020, and the Digital Personal Data Protection Act, 2023, MindAlgo has designated a Grievance Officer to address user concerns promptly and fairly.
Users may lodge grievances related to: (a) use of their personal or biometric data; (b) alleged breach of these Terms; (c) deficiency in service or unfair trade practices; or (d) any other concern arising from use of the Platform.
If a grievance is not resolved to your satisfaction within the prescribed timeframe, you may approach the competent Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.
MindAlgo reserves the right to update, modify, or revise these Terms at any time. In the event of a material change, we will provide notice to registered users via the email address associated with their account or through a prominent notification on the Platform, at least 7 (seven) days prior to the change taking effect.
Your continued use of the Platform following the effective date of any modification constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of the Platform before the effective date.
You may delete your account at any time via the Platform's account settings. Upon deletion, your access to all services will cease and your data will be handled in accordance with Section 11.6.
MindAlgo reserves the right to suspend or permanently terminate your account, with or without notice, in the following circumstances:
MindAlgo reserves the right to modify, suspend, or discontinue any part of the Platform at any time with reasonable notice to users. In the event of full service discontinuation, active paid subscribers will be entitled to a pro-rata refund of any prepaid fees for unused service periods.
These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of India.
Any disputes shall be subject to the exclusive jurisdiction of the Courts in Kozhikode (Calicut), Kerala, India.
Prior to initiating any legal proceedings, parties agree to attempt resolution of any dispute through good-faith negotiation for a period of not less than 30 (thirty) days following written notice of the dispute.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed from the remaining Terms, which shall continue in full force and effect.
These Terms, together with the Privacy Policy and any programme-specific agreements, constitute the entire agreement between you and MindAlgo Innovations Private Limited with respect to your use of the Platform and supersede all prior agreements, understandings, or representations.
